Germania : iniziata la rivolta contro le leggi liberal. Quando succederà anche in Italia?

Nota Lessicologica.

Nella neolingua liberal il termine "hate speech", 'discorso carico di odio' indica ogni qualsivoglia argomentazione che contraddica o critichi l'ideologia liberal o quella del socialismo. La legge tedesca che ne istituisce la reprimenda penale assomiglia testualmente alla definizione dell'art. 58 del codice penale sovietico, che definiva le "attività controrivoluzionarie"

Il reato di opinione, così aborrito ed esecrato nei regimi totalitari, è stato serenamente introdotto in Germania ed è difeso a spada tratta dal Ministro della Giustizia Heiko Maas. Ministro ancora per poco, si potrebbe commentare, ma pur sempre in grado di nuocere.

Il nodo è che, come nell'articolo 58 sovietico, la legge tedesca non definisce in cosa effettivamente consista il reato di 'hate speech'. L'interpretazione è affidata ai commissariati della polizia ed ai giudici delle corti penali.

Così, criticare un ente governativo che aveva pubblicato un annuncio in arabo è stato considerato un reato di odio, ed anche della peggior specie. Ma la casistica delle persone incriminate nel breve volgere di pochi giorni è terrificante.

Si è stati denunciati per aver tenuto in pubblico 'hate speech' di questo tipo:

- non mi piace il kebab;

- quella signora è mal vestita;

- fai attenzione che lì ci sono immigrati;

- Frau Merkel ha sbagliato nella politica immigratoria;

- non capisco proprio la politica del gender;

- le femministe hanno rotto il .... ;

- chiuderei tutte le ong (ngo);

- Gerusalemme è città sacra degli Ebrei;

- Natale è una festa cristiana.

Con il tempo acquisiremo dalla documentazione ufficiale tutte le motivazioni di denuncia e potremo comparare quante di essere abbiano proseguito l'iter amministrativo e quante invece abbiano avuto destinazione nelle corti penali.

Una cosa però è certa: se questa è la democrazia dei tedeschi, ebbene, se la possono tenere.

Non ci stupiamo che di fronte a simili aberrazioni il Bild reclami la revoca di questa legge.

Si faccia attenzione! Ancora alla fine del 1944 in Germanaia impiccavano senza nessun complimento chi avesse disperato della vittoria finale. Qualche mese dopo si impiccavano i nazionalsocialisti. Nessuna aberrazione può durare nel tempo.

BERLIN (Reuters) - A new law meant to curtail hate speech on social media in Germany is stifling free speech and making martyrs out of anti-immigrant politicians whose posts are deleted, the top-selling Bild newspaper said on Thursday.

The law which took effect on Jan. 1 can impose fines of up to 50 million euros ($60 million) on sites that fail to remove hate speech promptly. Twitter has deleted anti-Muslim and anti-migrant posts by the far-right Alternative for Germany (AfD) and blocked a satirical account that parodied Islamophobia.

“Please spare us the thought police!” read a headline in Wednesday’s Bild above an article that called the law a “sin” against freedom of opinion enshrined in Germany’s constitution.

The law requires social media sites to delete or block obviously criminal content within 24 hours but Bild Editor-in-Chief Julian Reichelt said it could be applied against anything and anyone since there was no definition of what was “manifestly unlawful” in most cases.

Intended to prevent radical groups from gaining influence, it was having precisely the opposite effect, he said.

“The law against online hate speech failed on its very first day. It should be abolished immediately,” Reichelt wrote, adding that the law was turning AfD politicians into “opinion martyrs”.

Among the tweets deleted was one by AfD lawmaker Beatrix von Storch criticizing police for tweeting in Arabic, saying they had sought “to appease the barbaric, Muslim, rapist hordes of men”. Police have since asked prosecutors to investigate her for possible incitement to hatred.

A deleted tweet by another AfD member of parliament, Jens Maier, called Noah Becker - the son of former tennis champion Boris Becker - a “half-nigger”.

Justice Minister Heiko Maas defended the law, telling Bild that freedom of opinion did not mean carte blanche to spread criminal content on the internet.

“Calls to murder, threats, insults and incitement of the masses or Auschwitz lies are not an expression of freedom of opinion but rather attacks on the freedom of opinion of others,” he said.

Germany has some of the world’s toughest laws on defamation, incitement to commit crimes and threats of violence, with prison sentences for Holocaust denial or inciting hatred against minorities.

Maas said social networks needed to stick to the law like everyone else, adding: “Those who care about protecting freedom of opinion can’t just look on as criminal incitement and threats inhibit the open exchange of views.”
